Buyer Agents Commission Disclosure

Although I am representing you as a Buyer's Agent, the Seller will, in most cases, be paying me a commission. The majority of homes on the market offer the Buyer's Agent a range between 2.5% on the 1st $100,000 and 1.15% on the balance to 3.5% -1st $100K and 1.15% on balance of the final purchase price.(It is likely that in the future the Buyer will directly pay a commission to their Buyer's Agent and the Seller will pay a commission to their Seller's Agent). Representing you as your Buyer's Agent is a commitment of my time, effort and experience I take on with very high regard. My minimum Buyer Agent commission is 2.5%-1st $100K and 1.15% on balance. You must bear in mind that in the event of a law suit, my deductible for Errors & Ommission Insurance is $4000. Which also means that for those properties I sell to a Buyer under $250,000, I am earning less then $4000 and at risk of taking a loss if a law suit should occur. If the Buyer agrees to my Buyer Agency Agreement then in the few occassions where a Seller offers a commission that is lower then this minimum percentage, I will be asking the Buyer to authorize me to negotiate this minumum commission with the Seller before presenting the Buyer's offer. If the Seller does not agree to pay this minimum amount then the Buyer, agrees to pay Coldwell Banker Westburn Realty the shortfall. It is likely that once a deal has been agreed upon, the Seller will allow us to add this amount to the agreed purchase price. Where a bonus commission is being offered to the Buyer Agent that is above 3.5% -1st $100K and 1.15% on balance, then this amount will be paid to the Buyer. Alternatively, the Buyer will have the option to direct me not to show any property that is below my minimum commission. After our first meeting you will understand what I bring to the table and either believe I'm worth it or not. I've been around since 1979, before the personal computer, internet, email, fax machine, pager, and the cell phone.......yes, there was fire! My experience and know-how in all facets of real estate is why I've been able to be in business for over a quarter of a century and why Buyers have asked me to represent them as their Buyer's Agent when looking for a home or investment property.
